About Us

Carol, Heidi, and Erin make up the education law group as of counsel attorneys to Lear & Lear, LLP.  Coming from the public education world, they have experience in schools as teachers, administrators, and adjunct professors. Their experience in schools drives their understanding and application of school law, though each has had experience in other areas of law, as well.   They have for a combined total experience in education and in law of over fifty years.


CarolCarol Lear is well known name among Utah educators and even national school law organizations.  She has served as Director of Law and Legislation at Utah State Office of Education (USOE) for the past 10 years, complemented by her other experience as follows:

  • 1972-1977, High School Teacher, Granite School District
  • 1982, Graduate of U of U S. J. Quinney College of Law
  • 2000, Administrative/Supervisory License Utah State University
  • 1999-2014, Coordinator/Director of School Law and Legislation, Utah State Office of Education
  • 1999-present, Adjunct Professor, Graduate Department of Education, U of U and USU
  • Utah Law-Related Education Program Board of Trustees
  • National Council of State Education Attorneys (NCOSEA), Chair 2004
  • NCOSEA Douglas Bates Distinguished Service Award, 2010



Heidi Alder has worked with school districts and charters around the state for the past several years.  In addition to her role as USOE Education Specialist and Prosecutor for the Utah Professional Practices Advisory Commission, Heidi has the following experience:

  • 2002-2005, Associate Attorney, Snow, Christensen & Martineau Law Firm
  • 2006, Research Attorney, University of Utah Office of General Counsel
  • 2006-2011, Teacher Vista Private School

Erin PrestonErin Preston has spent the eight years as a founder, board chair and director of a successful K-12 International Baccalaureate charter school.  Erin is able to combine her legal knowledge with the day to day realities of creating, governing and operating a public school district.  This unique background gives her the ability to analyze the legal issues school districts and their boards regularly face, as well as understand emerging legal issues that will impact future school operations.

  • 1996 – Graduate of BYU Law School
  • 1996-1999 – U.S. Securities & Exchange Commission – Enforcement Attorney
  • 1999-2005 –  Northwest Regional Manager for legal publisher Lexis-Nexis
  • 2005-2009 – Board Member, Children’s Justice Center of Salt Lake
  • 2007-2011 – Founding Member & Board Chair of Providence Hall Charter School
  • 20011-2014 – Superintendent of Providence Hall, a K-12 2000+ student International Baccalaureate school in Herriman, Utah.
  • 2008-2014 – Independent School Construction Specialist – organized and supervised the construction of 11 Utah schools
  • 2014 – Co-chair of UAPCS Legislative Policy Committee
